The Cambridge Group of Clubs (hereinafter “CGoC”, “we”, “our” or “us”) is committed to safeguarding and handling your personal information in a responsible and secure manner.

This Privacy Policy (“Policy”) describes how we process your personal information as you use our websites located at www.thecambridgeclub.com, www.torontoathleticclub.com, and www.adelaideclub.com (collectively, the “Sites”), visit our clubs, and use any of the services, tools, technology, products, features, and events (collectively, the “Services”) provided, operated or owned by CGoC. When we collect, access, use or do anything with your personal information, we are “processing” your personal information.

We may modify this Policy at any time. If we make changes, we will notify you by revising the date at the top of this Policy. We will provide you with advanced notice by the email or telephone number which we have on file or through a notice on our Sites if we make any material changes to how we collect, use or disclose your personal information. If you continue to access or use our Services after receiving the notice of changes, you acknowledge your acceptance of the updated Policy.

Information We Collect

Personal information is any information that is related to you, identifies you or makes you identifiable. We collect different types of personal information when you access or use our Services, including:

We do not read any of your private online communications.

  • Membership Information: We may collect personal information about how you use our Services, including check-ins to, and purchases made at the club and other information provided when you book a court, or purchase or schedule a class or other training session.

  • Information From our Premises: We use video monitoring in public areas of our premises to maintain security. If we host an event, photographs may also be taken.

  • Information Collected Through Our App: Through our membership application, we may collect information such as your class or court bookings and billing information.

  • Job Applicant Information: If you apply for a job with us, we collect information necessary to process your application or to retain you as an employee, which may include education and job history information. Providing this information is required for us to consider you for employment.

  • Public Health and Safety: In certain situations where a serious public health threat has been identified, we may collect information from employees, members, and other individuals accessing our facilities. This may include medical and health information, such as body temperature and symptoms. We collect this information to protect the health and safety of our employees and members. We may be required by law, regulation, or governmental order to collect and retain information related to issues of public health and safety.
How We Use Your Information

Your Personal Information can be used for various purposes, including:

  • To Provide Our Services: When you access or use our Services, we process certain personal information about you to be able to provide you with our Services. Some examples of how we process your personal information include, but are not limited to: allowing you to sign up for a membership with one of our clubs, booking personal training sessions or classes, paying fees for our Services, and to analyze your use and enjoyment of our Services.

  • To Communicate With You: If you sign-up to become a member at one of our clubs, you will receive communications from us regarding our Services. These communications are transactional messages about your account, billing information, surveys, support, customer service, events, policy changes, or other notifications relating to our Services. These communications are necessary for us to provide our Services to you.

  • Marketing Communications: We may also use your personal information for marketing, promotional, or other related communications and initiatives. You can manage your email preferences and opt out of certain communications, such as by clicking the “unsubscribe” link found within non-transactional communications or by emailing us at the contact information listed at the end of this Policy.

  • Surveys: We may ask you to fill out a survey to obtain feedback about your experience with our Services. We use this information to help us improve our Services, understand our customers, and enhance our Sites and other offerings.

We cannot provide the Services to you without such processing.

  • De-Identified Information: To the extent we maintain and use personal information in a de-identified form, we will not attempt to re-identify the information, except for the purpose of determining whether our de-identification processes satisfy our legal obligations.
How We Share Your Information

We do not sell or disclose your personal information to third parties without your consent, except as set forth below or as required or permitted by law.

  • Third-Party Service Providers: Your personal information will be transferred (or otherwise made available) to certain third parties that provide services on our behalf. We may use third parties to perform certain services, such as:

    • For marketing and advertising;
    • To support our IT and security efforts.

Our service providers are located in Canada, the U.S. and other foreign jurisdictions.

  • Reciprocal Clubs: We may share your information with reciprocal clubs located in Ontario, the United States and other foreign jurisdictions to the extent you plan to visit one of those clubs. Such information may include your name, dates of travel, and member number.

  • Merger, Bankruptcy or Corporate Reorganization: We may disclose and transfer your personal information to a subsequent owner, co-owner, or operator of CGoC or the Services, or in connection with a merger, consolidation, restructuring, the sale of all or substantially all of our interests and/or assets (i.e., a bankruptcy proceeding), or other corporate change. We will notify you with any choices you may have regarding your personal information when we are engaged in a merger, bankruptcy, or corporate reorganization.

  • Legal Obligations and Safety: We and our Canadian, US and other foreign service providers may provide your personal information in response to a search warrant to other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by US or foreign courts, law enforcement or other government authorities. Your personal information may also be disclosed where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.

  • Analytics: We also use web analytics services such as Google Analytics. They use cookies to help us analyze how visitors use the Website. For example, with Google Analytics, the information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by a Google server. Google uses this information for the purpose of evaluating your use of the Site, compiling reports on Site activity for us, and providing us with other services relating to Site activity and internet usage. Your Choices
  • Your Account: You may access your account information by logging onto our membership portal. You can edit your personal information as necessary, such as your email address, name, phone number, and more. When you update your account information, we may keep a copy of your previous account details for our records and to prevent fraud or other activities that violate our terms, policies and agreements. However, if you do not provide us with some of your personal information, such as your name or email, we will no longer be able to provide you with access to our Services.

  • Voluntary Information: You may choose not to provide us with some of your personal information. For example, you are not required to complete any survey we send to you.

  • Communication Preferences: If you do not want to receive emails from us, please adjust your communication preferences or click the unsubscribe link within the email you received from us. You will not be able to unsubscribe from Service-related communications as they are necessary for us to continue offering you the Services.

  • Account Deletion: If you wish to delete your account completely, please email us at the contact information below. Please note that our deletion of your personal information is subject to limitations, including any applicable legal retention requirements.

  • Cookies Preferences: Our Sites use a technology called "cookies". A cookie is a tiny element of data that our Sites send to a user‘s browser, which may then be stored on the user‘s hard drive so that we can recognize the user‘s computer or device when they return. Safeguarding

To protect your personal information, we have implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. We restrict access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfil their job requirements.

You should be aware that, unfortunately, no system can be 100% secure. There will always be a risk that your personal information gets compromised. We also depend on you to keep your account information secure by keeping your password confidential and taking precautions to keep others from accessing your account. Please notify us immediately at contact information notes below if you become aware of any unauthorized access to or use of your account.

Retention

We generally retain your personal information as long as necessary to fulfill the purposes of collection, including for the purposes of satisfying any legal, accounting, or reporting obligations or to resolve disputes. Otherwise, we will try to delete your personal information upon your request or when we no longer need it for the purposes it was originally collected. We will not delete any personal information that also relates to other individuals, unless such other individuals also wish to delete their personal information at the same time. We only retain video surveillance information for a period of 7 days.

Under Canadian privacy law, you have the right to request access to your personal information that we have in our custody or control, and to request updating and/or correction to same, subject to certain exceptions and restrictions.

You may request access, updating and corrections of inaccuracies in your personal information in our custody or control by emailing or writing to us at the contact information set out below. We will respond to your request within a reasonable timeframe and in compliance with applicable laws. We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records.
